FRANCE: First update of the official list of biocontrol products

The French Ministry of Agriculture, Food and Forestry has published the first update of the official list of biocontrol plant protection products in accordance with articles L.253-5 and L.253-7 of the Rural Code.

Some criteria of inclusion into the list were reviewed.

The note sets that the plant protection products containing an active substance candidate for substitution (Regulation (EU) 2015/408) cannot be included in the official list of biocontrol product.

As regards human health, the hazard statements H317 (skin sensitiser) and H334 (respiratory sensitiser) are not considered as criteria of exclusion anymore.

Lastly, insecticide products with a large spectrum of action are not excluded anymore either.

EFSA Public consultation: Guidance for the identification of biological relevance of adverse/ positive health effects from experimental animal and human studies

The public consultation on the draft guidance document of the EFSA Scientific Committee on the identification of biological relevance of adverse/ positive health effects from experimental animal and human studies is opened until 1st May 2017.

Generic issues and criteria are given to consider biological relevance, particularly when deciding on whether an observed effect is of biological relevance, i.e. is adverse (or shows a positive health effect) or not. The opinion clarifies a number of definitions and concepts, such as, responses of a biological system to exposure, mode of action and adverse outcome pathways, thresholds, critical effect, modelling approaches, etc. It also proposes several case studies.

EFSA Public consultation: Guidance on The Use of the Weight of Evidence Approach in Scientific Assessments

The public consultation on the draft guidance document of the EFSA Scientific Committee on The Use of the Weight of Evidence Approach in Scientific Assessments is opened until 1st May 2017.

The guidance document addresses the use of the weight of evidence in scientific assessments using both qualitative and quantitative approaches. Several case studies covering the various areas under EFSA’s remit are annexed to the guidance document to illustrate the applicability of the proposed approach.

EUROPE: Glyphosate not classified as a carcinogen by ECHA

ECHA’s Committee for Risk Assessment (RAC) agrees to maintain the current harmonised classification of glyphosate as a substance causing serious eye damage (H318) and being toxic to aquatic life with long-lasting effects (H411). RAC concluded that the available scientific evidence did not meet the criteria to classify glyphosate as a carcinogen, as a mutagen or as toxic for reproduction.

Apart from the published studies on glyphosate, the committee also had full access to the original reports of studies conducted by industry. RAC has assessed all the scientific data, including any scientifically relevant information received during the public consultation in summer 2016.

The adopted opinion will go through a normal editorial check before it is sent to the European Commission. The opinion will also be made available on ECHA’s website at the same time.

The adopted opinion on the harmonised classification for glyphosate will be taken into account when the Commission and Member States consider whether to renew the approval to use glyphosate as an active substance in pesticides, later this year.

FRANCE: Promotion of biocontrol – Publication of the Law ‘Potier’

The law No.2017-348 concerning the fight against agricultural land grabbing and the development of biocontrol was published on Tuesday 21 March in the French Official Journal.

As for biocontrol, the law first extends the exemptions to the pesticides ban in amenity areas, forests, public roads, and walking paths accessible or opened to the public. Indeed, the use of pesticides is authorised in case of a serious sanitary hazard threatening the sustainability of the historical or biological heritage and that cannot be controlled  by another way, including a non-chemical method.

In addition, the exemption of phytosanitary certification is extended to all biocontrol products, except those being classified, and to the basic substances. So far, this exemption only concerned the list of biocontrol plant protection products set in November 2016 in accordance with articles L.253-5 and L.253-7 of the Rural Code.

The law also extends the exemption of operator certification called Certiphyto for chemical mediators and basic substances.

Lastly, this law re-implements the plant protection products saving certificates (‘CEPP’). Indeed, the Ordinance regarding the experimental CEPP procedure was called off by the Council of State in December 2016 further to an appeal of pesticides producers and distributors.

FRANCE: Re-implementation of plant protection products saving certificates (‘CEPP’)

The law No.2017-348 of 20 March 2017 concerning the fight against agricultural land grabbing and the development of biocontrol re-implements the plant protection products saving certificates (‘CEPP’). Indeed in December 2016, the Ordinance No.2015-1244 of 7 October 2015 regarding the experimental CEPP procedure was called off by the Council of State for procedural reasons further to an appeal of pesticides producers and distributors.

An assessment of the experimental procedure aiming at setting up actions contributing to savings of plant protection products will be performed and published before 1st January 2020.

A draft decree repeats the provisions of Decree No. 2016-1166 of 26 August 2016 concerning the implementation of CEPP and is subject to public consultation from 8 March to 29 March 2017. The draft decree sets the conditions and modalities for the calculation and the implementation by distributors of actions contributing to the reduction of the pesticides use, risks and impacts. The unit amount of the fixed penalty by missing CEPP Certificate on 31 December 2021 compared to the notified obligation  is 5 euros.

FRANCE: Publication of the Order regarding the list of organisations for phytopharmacovigilance (monitoring system)

As announced in Decree No.2016-1595, the Order of 16 February 2017 establishes in Appendix 1 the list of entities included in the monitoring system and in appendix 2 the list of organisations to which the declarations of manufacturers, importers, distributors, professional users, advisers and trainers of users of plant protection products and adjuvants are addressed.
