FRANCE: Towards glyphosate phase out

The renewal of the glyphosate approval for five years was adopted in December 2017 by the European Commission. The evaluation by ANSES (French Agency for Food, Environmental and Occupational Health & Safety) of applications for the renewal of authorisation of glyphosate-based PPPs according to Article 43 of Regulation (EC) 1107/2009 is in progress.

To date, 190 glyphosate-based products are authorised in France or benefit from a parallel trade permit. 58 applications for PPPs renewal and 11 applications for new PPPs approval were submitted to ANSES. Regarding the 132 products for which  renewal application was submitted, ANSES notified the products’ holders of the expiry of approvals or parallel trade permits as from 15 December 2018. The list of products concerned has been published on the E-phy website.

For products intended for professional use, the end of sale and distribution of the products is set to 15/03/2019 and the end of use of the products and stocks is set to 15/06/2019.
For products intended for amateur use, no grace period is granted in view of the entry into force on 1 January 2019 of the Labbé’s law (February 2014) amended by the Energetic transition law (August 2015) and the Potier’s law (March 2017), prohibiting the marketing and holding of non-professional PPPs.

ANSES announces that the evaluation of the new approval applications and renewal applications will be finalized before 31 December 2020, within the three-year period announced by the government.

In addition, the evaluation of the new approval applications and renewal applications will be conducted on the basis of a comparative assessment of the products: based on the information that will be provided on the available alternatives commonly used in France, particularly by INRA (French National Institute for Research in Agriculture), ANSES will compare, for each use, glyphosate products with the non-chemical methods of prevention or control that are available. For each glyphosate-based product, uses for which there is an alternative that meets the substitution criteria will therefore be prohibited.

Finally, in order to support farmers foregoing glyphosate use, the government launched a website sharing experiences from farmers who have already taken part in this initiative and describing possible alternatives to glyphosate. The website also records the plots declared without glyphosate in each department as well as the number of farmers having stop any use of glyphosate and engaged in this way.

FRANCE: New update of the memo relative to trials and experiments of regulated products

ANSES has issued a new version of the Memo relative to trials and experiments of regulated products (plant protection products/fertilisers) dated 01/09/2017; the previous Memo was dated 19/06/2017. The changes are as followpermiss:

The form to be filled in for an application for plant protection product trial permit (CERFA 15720*01) as well as the explanatory note (Cerfa N°52171#01) are specified.

In the case of fertilisers and crop substrates, the amount of the fee levied by ANSES (fixed by the decree of 12 April 2017 – Article 7, point V and IX, paragraph 2, entered into force on 01/07/2017) for a trial permit application was revised and set at 1000 € for a single product and 2000 € for a set of products.

FRANCE – E-Phy: New data fields in CSV table

As part of the monthly update of E-Phy open data, new data fields were added in the CSV files to answer users’ requests.

The following fields are now available: ‘second brand names’, ‘registration holder’, ‘trade type’’ and ‘range of uses’. In addition, authorised claims and active substances were added for each product.

As a reminder, the CSV table contains all the authorised plant protection products in France. It is organised by product and by use (one row per use and product). The table contains all the authorised and withdrawn uses for each product.

FRANCE: Memo relative to trials and experiments

ANSES have issued a memo summarising the requirements for:

  • Applications for trial permits (replacing ‘ADE’), including:
    • Exemption from trial permit applications
    • Preliminary declaration of trials
    • Exemption of crop destruct
  • The declaration of officially recognised trials

FRANCE: Tax on the sale of Plant Protection Products (Order 09 March 2016)

The French Order of March 9 sets the tax rate to 0.2% of sales revenues for conventional plant protection products and 0.1% for biocontrol products.

This tax applies to plant protection products which were the subject of an Authorisation or a parallel trade permit.

This tax is assigned to ANSES to finance the establishment of the monitoring system called ‘phytopharmacovigilance’ (PPV) established by the French law for the future of Agriculture of 13 October 2014.

FRANCE : E-Phy website is back on-line

As part of its new responsibilities regarding approvals of plant protection products, fertilisers and growing media, and adjuvants, Anses is now in charge of E-Phy database, the national reference for the authorised uses of these products in France. Anses has just achieved the revision of the tool.

The new version, characterised by a more modern and intuitive user interface, is now available: https://ephy.anses.fr

The new E-Phy website keeps the same structure and spirit compared to the old tool: it is built on the principle of product sheets, the products being classified by category.

E-Phy also proposes new functionalities in order to meet expressed expectations, such as the characterisation of products authorised for organic farming.

The creation of filters facilitates the searches (product status, function, use, authorisation for amateurs, bee claims, etc.)

On the website, a presentation document (in French) gives several tips for browsing and searching.

At last, the new E-Phy website is intended to evolve. Other functionalities will be added in the coming months, always with the objective to increase the capacities of search and to meet the expectations of all users.
