{"id":4839,"date":"2021-07-05T08:48:54","date_gmt":"2021-07-05T08:48:54","guid":{"rendered":"https:\/\/lynxee.consulting\/?p=4839"},"modified":"2023-01-26T09:03:32","modified_gmt":"2023-01-26T09:03:32","slug":"france-public-consultation-on-new-measures-to-protect-pollinators","status":"publish","type":"post","link":"https:\/\/lynxee.consulting\/en\/france-public-consultation-on-new-measures-to-protect-pollinators\/","title":{"rendered":"FRANCE: Public Consultation on New Measures to Protect Pollinators"},"content":{"rendered":"<p style=\"text-align: justify\">The Ministries of Agriculture and Environment have launched the <b>public consultation<\/b> on the <b>draft National Plan for Pollinators <\/b>(<a href=\"http:\/\/www.consultations-publiques.developpement-durable.gouv.fr\/plan-national-en-faveur-des-insectes-a2416.html\" target=\"_blank\" rel=\"noopener noreferrer\">Access to consultation<\/a>) and the <b>draft \u201cbee\u201d Order<\/b> to replace the <a href=\"https:\/\/www.legifrance.gouv.fr\/loda\/id\/JORFTEXT000000799453\/\" target=\"_blank\" rel=\"noopener noreferrer\">Order of 2003<\/a> as regards the Conditions of Use of Insecticides and Acaricides to Protect Bees and Other Pollinating Insects (<a href=\"http:\/\/www.consultations-publiques.developpement-durable.gouv.fr\/projet-d-arrete-relatif-a-la-protection-des-a2415.html\" target=\"_blank\" rel=\"noopener noreferrer\">Access to consultation<\/a>). The consultation is open until <b>20 July 2021<\/b>.<\/p>\n<h5><b>Draft National Plan for Pollinators<\/b><\/h5>\n<p style=\"text-align: justify\">The draft National plan contains various actions to be carried out over the period 2021-2026 to \u201cact in favour of pollinating insects, wild and domestic, and of pollination\u201d. It is articulated around six axes:<\/p>\n<ol>\n<li style=\"text-align: justify\">Improving scientific knowledge (including on wild pollinator populations, and stressors affecting domestic and wild pollinator populations),<\/li>\n<li style=\"text-align: justify\">Economic levers and supports for farmers, beekeepers and foresters,<\/li>\n<li style=\"text-align: justify\">Supports for other activity sectors (urban development, linear infrastructure, industrial sites, sites with large land rights, protected areas),<\/li>\n<li style=\"text-align: justify\">Preservation of bee health (<em>e.g. <\/em>strengthening of bee health monitoring),<\/li>\n<li style=\"text-align: justify\">Regulation of plant protection products (PPPs) to protect pollinators (it includes the strengthening of the provisions of the \u201cbee\u201d Order of 2003 \u2013 detailed below),<\/li>\n<li style=\"text-align: justify\">Sharing of pollinator-friendly farming practices.<\/li>\n<\/ol>\n<h5><b>Draft \u201cBee\u201d Order<\/b><\/h5>\n<p style=\"text-align: justify\">In order to reduce the impact of PPPs on pollinators when applied during flowering, two main evolutions were retained in the draft \u201cBee\u201d Order on the basis of Anses recommendations (see our previous articles):<\/p>\n<ul>\n<li style=\"text-align: justify\"><b>Extension of the flowering-period specific assessment<\/b> to all PPPs, <i>i.e.<\/i>, inclusion of <b>fungicides <\/b>and <b>herbicides<\/b>:<br \/>\nPPP applications on attractive flowering crops and on \u201cbee foraging areas\u201d would only be possible \u201cif there is no unacceptable effect on bees (acute or chronic), nor on colony survival and development\u201d. Anses would specify the data required for the evaluation.<\/li>\n<li style=\"text-align: justify\"><b>Limitation of the PPP application period<\/b> when used on flowering crops and on \u201cbee foraging areas\u201d:<br \/>\nApplications would have to be carried out within <b>2 hours before sunset and 3 hours after sunset<\/b>. This restriction period could be adapted or waived if measures providing an equivalent level of protection to pollinators are implemented (such measures are still to be defined with the support of Anses). Exemptions would also be possible in the case of technical deadlock.<\/li>\n<\/ul>\n<p style=\"text-align: justify\">As regards <b>attractive plant covers under perennial crops<\/b>, covers would have to be rendered unattractive to pollinators prior to any insecticide or acaricide application on crops. The other types of PPPs would not be concerned by this measure.<\/p>\n<p style=\"text-align: justify\"><b>Transitory measures<\/b> are planned for the entry into force of the new \u201cbee\u201d Order:<\/p>\n<ol>\n<li style=\"text-align: justify\"><b>Limitation of the PPP application period<\/b> when used on flowering crops and on \u201cbee foraging areas\u201d would be <b>immediately applicable<\/b> to insecticides and acaricides for which an authorisation of application during flowering and\/or exudate production period is already granted (current \u201cBee Claim\u201d procedure), AND for PPPs other than insecticides and fungicides.<\/li>\n<li style=\"text-align: justify\">For PPPs other than insecticides and fungicides whose authorisation renewal will be in less than 30 months after the entry into force of the new \u201cbee\u201d Order:<br \/>\nPPP application on flowering crops and on \u201cforaging bee areas\u201d would remain possible pending Anses risk assessment conclusions and <b>provided that the required additional data are submitted within 30 months<\/b> after the entry into force of the \u201cbee\u201d Order.<\/li>\n<li style=\"text-align: justify\">For PPPs other than insecticides and fungicides whose authorisation renewal will be in more than 30 months after the entry into force of the new \u201cbee\u201d Order AND in the case of major uses in France:<br \/>\nPPP application on flowering crops and on \u201cforaging bee areas\u201d would remain possible pending Anses risk assessment conclusions and <b>provided that the required additional data are submitted within 48 months<\/b> after the entry into force of the \u201cbee\u201d Order.<\/li>\n<li style=\"text-align: justify\">If the required additional data are not submitted within the deadlines (30 or 48 months), PPP application on flowering crops and on \u201cforaging bee areas\u201d would no longer be possible.<\/li>\n<li style=\"text-align: justify\">A <b>notification <\/b>of the submission of the required additional data and of the uses concerned would have to be made <b>18 months before <\/b>the submission.<\/li>\n<li style=\"text-align: justify\">For PPPs other than insecticides and fungicides whose authorisation renewal will be in more than 30 months after the entry into force of the new \u201cbee\u201d Order AND in the case of minor uses in France:<br \/>\nPPP application on flowering crops and on \u201cforaging bee areas\u201d would remain possible pending Anses conclusions on the renewal dossier. The required additional data would have to be submitted with the renewal dossier with no specific notification needed.<\/li>\n<\/ol>\n<p style=\"text-align: justify\">Given the current timeline, the <b>new \u201cbee\u201d Order could be released by the end of 2021<\/b>.<\/p>\n<h5><b>European context<\/b><\/h5>\n<p style=\"text-align: justify\">The strengthening projet of the French measures for pollinators happens in a context of evolution of the pollinator protection policy at European level, with the current revision of the <b>EFSA guidance document <\/b>(<a href=\"https:\/\/efsa.onlinelibrary.wiley.com\/doi\/epdf\/10.2903\/j.efsa.2013.3295\" target=\"_blank\" rel=\"noopener noreferrer\">EFSA Journal 2013;11(7):3295<\/a>; see our previous articles) and with the revision of the <b>uniform principles <\/b>for evaluation and authorisation of PPPs as regards pollinators (<a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/en\/TXT\/HTML\/?uri=CELEX:02011R0546-20180524&amp;qid=1625575042245&amp;from=en\" target=\"_blank\" rel=\"noopener noreferrer\">Regulation (EU) No. 546\/2011<\/a>).<\/p>\n<p style=\"text-align: justify\">On 28 June 2021, a majority of Member States voted in favour of the European Commission\u2019s proposal for a <b>protection goal of 10% as a maximum permitted level of honeybee colony size reduction<\/b>. This threshold will now be integrated into the draft <b>updated EFSA guidance document <\/b>for finalisation.
