{"id":5554,"date":"2022-01-25T07:34:59","date_gmt":"2022-01-25T07:34:59","guid":{"rendered":"https:\/\/lynxee.consulting\/?p=5554"},"modified":"2023-01-26T14:01:43","modified_gmt":"2023-01-26T14:01:43","slug":"france-new-decree-setting-the-conditions-for-inclusion-on-the-lists-of-biocontrol-products","status":"publish","type":"post","link":"https:\/\/lynxee.consulting\/en\/france-new-decree-setting-the-conditions-for-inclusion-on-the-lists-of-biocontrol-products\/","title":{"rendered":"FRANCE: New decree setting the conditions for inclusion on the lists of biocontrol products"},"content":{"rendered":"<p><a href=\"https:\/\/www.legifrance.gouv.fr\/jorf\/id\/JORFTEXT000045010267\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400\">Order no. 2022-35 of 17.01.2022 setting the conditions for inclusion on the lists of biocontrol products mentioned in Articles L.253-5 and L.253-7 of the Rural and Maritime Fishing Code<\/span><\/a><span style=\"font-weight: 400\"> will come into force on 01.02.2022.<\/span><\/p>\n<p><span style=\"font-weight: 400\">It responds to the 1st objective of the axis &#8220;Regulation: Simplify the procedures for the authorisation and the use of biocontrol solutions&#8221; of the national strategy for the deployment of biocontrol published on 10.11.2020.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Biocontrol is defined in Article <\/span><a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000042911985\/2022-01-25\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400\">L.253-6<\/span><\/a><span style=\"font-weight: 400\"> of the Rural and Maritime Fishing Code as all agents and products using natural mechanisms in the context of integrated pest management.<\/span><\/p>\n<p><span style=\"font-weight: 400\">This order sets, from a regulatory point of view, the criteria that must be met by a plant protection product to be included in the lists of biocontrol products mentioned in Articles L. 253-5 and L. 253-7 of the Rural and Maritime Fishing Code. These criteria take into account t<\/span><b>he natural origin of the substance<\/b><span style=\"font-weight: 400\"> and the <\/span><b>dangers to public health or the environment<\/b><span style=\"font-weight: 400\"> that the product may present. Exceptions are foreseen when the type of formulation or the method of application lead to negligible environmental exposure. The main change in comparison of the current exclusion criteria is the inclusion of the hazard statement H334 (respiratory sensitisation).<\/span><\/p>\n<p><span style=\"font-weight: 400\">Plant protection products including active substances which meet the criteria below may be included in the lists mentioned in Articles <\/span><a href=\"https:\/\/www.legifrance.gouv.fr\/affichCodeArticle.do?cidTexte=LEGITEXT000006071367&amp;idArticle=LEGIARTI000006583208&amp;dateTexte=29990101&amp;categorieLien=cid\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400\">L.253-5<\/span><\/a><span style=\"font-weight: 400\"> and<\/span><a href=\"https:\/\/www.legifrance.gouv.fr\/affichCodeArticle.do?cidTexte=LEGITEXT000006071367&amp;idArticle=LEGIARTI000006583212&amp;dateTexte=29990101&amp;categorieLien=cid\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400\"> L.253-7<\/span><\/a><span style=\"font-weight: 400\">:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Substances of natural animal, plant or mineral origin naturally present and identified in their natural state, which are either extracted from a natural source material, or obtained by synthesis and are strictly identical to the natural substance;<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Substances from prokaryotes, unicellular eukaryotes or fungi;<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Micro-organisms and chemical mediators.<\/span><\/li>\n<\/ul>\n<p><b>Criteria for exclusion<\/b><span style=\"font-weight: 400\"> from these lists are defined:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Products containing an active substance identified as candidate for <\/span><b>substitution<\/b><span style=\"font-weight: 400\">;<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Products whose <\/span><b>classification <\/b><span style=\"font-weight: 400\">includes one of the following hazard statements: H300, H301, H310, H311, H330, H331, H334, H340, H341, H350, H350i, H351, H360, H360D, H360F, H360FD, H360Df, H360Fd, H361 , H361d, H361f, H361fd, H362, H370, H371, H372, H373;<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Products whose classification includes the hazard statement H400 or H410, unless the type of formulation and the mode of application lead to negligible exposure of non-target organisms.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400\">In addition, products made of a <\/span><b>device combining an attractant and an active substance with an insecticidal effect<\/b><span style=\"font-weight: 400\"> can be included on the lists mentioned in Articles L. 253-5 and L. 253-7 on the basis of the compliance of the attractant alone with the conditions mentioned above, as long as the device makes it possible to prevent the dissemination of the insecticide in the environment.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><b>See also our previous articles:\u00a0<\/b><\/p>\n<p><a href=\"https:\/\/lynxee.consulting\/en\/france-implementation-of-the-national-biocontrol-strategy-for-2020-2025\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400\">FRANCE: Implementation of the national biocontrol strategy for 2020-2025<\/span><\/a><\/p>\n<p>&nbsp;<\/p>\n<p><b>Lynxee consulting<\/b><span style=\"font-weight: 400\">\u2019s team is at your disposal to answer your questions.<\/span><\/p>\n<p><b>Contact us!<\/b> <a href=\"http:\/\/lynxee.consulting\/en\/contact\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400\">http:\/\/lynxee.consulting\/en\/contact\/<\/span><\/a><\/p>\n<p>&nbsp;<\/p>\n<p>Photo credit : adege\/pixabay<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Order no. 2022-35 of 17.01.2022 setting the conditions for inclusion on the lists of biocontrol products mentioned in Articles L.253-5 and L.253-7 of the Rural and<span class=\"excerpt-hellip\"> [\u2026]<\/span><\/p>\n","protected":false},"author":6,"featured_media":5552,"comment_status":"closed","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[36],"tags":[138,68,124],"class_list":["post-5554","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-regulation","tag-biocontrol","tag-france-en","tag-france-en-2"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v26.1.1 -
