{"id":6548,"date":"2023-03-22T10:52:52","date_gmt":"2023-03-22T10:52:52","guid":{"rendered":"https:\/\/lynxee.consulting\/?p=6548"},"modified":"2023-04-13T06:28:07","modified_gmt":"2023-04-13T06:28:07","slug":"europe-com-adoption-of-the-regulation-for-the-identification-of-unacceptable-co-formulants","status":"publish","type":"post","link":"https:\/\/lynxee.consulting\/en\/europe-com-adoption-of-the-regulation-for-the-identification-of-unacceptable-co-formulants\/","title":{"rendered":"EUROPE \u2013 COM : Adoption of the regulation for the identification of unacceptable co-formulants"},"content":{"rendered":"<p style=\"text-align: justify\"><span style=\"font-weight: 400\">Following the public consultation on the draft regulation, the Commission published on 14 March 2023 in the Official Journal of the European Union<\/span><a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/FR\/TXT\/?uri=uriserv%3AOJ.L_.2023.075.01.0007.01.FRA&amp;toc=OJ%3AL%3A2023%3A075%3ATOC\" target=\"_blank\" rel=\"noopener\"> <b>Regulation (EU) 2023\/574<\/b><\/a><b> setting out detailed rules for the identification of unacceptable co-formulants in PPP <\/b><span style=\"font-weight: 400\">in accordance with Regulation (EC) No 1107\/2009 of the European Parliament and of the Council.<\/span><\/p>\n<p style=\"text-align: justify\"><span style=\"font-weight: 400\">The annex to Regulation (EU) 2023\/574 lists the <\/span><b>10 criteria for identifying a co-formulant as unacceptable <\/b><span style=\"font-weight: 400\">(<\/span><a href=\"https:\/\/lynxee.consulting\/en\/europe-com-public-consultation-draft-regulation-for-the-identification-of-unacceptable-co-formulants\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400\">see our previous article<\/span><\/a><span style=\"font-weight: 400\">) and the regulation specifies <\/span><b>the assessment procedure that may lead to inclusion in annex III of Regulation (EC) No 1107\/2009 listing co-formulants <\/b><b>which are not accepted for inclusion in PPP<\/b><b>.\u00a0<\/b><\/p>\n<p style=\"text-align: justify\"><span style=\"font-weight: 400\">A first list of unacceptable co-formulants has been established by Commission<\/span><a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/FR\/ALL\/?uri=CELEX%3A32021R0383\" target=\"_blank\" rel=\"noopener\"> <span style=\"font-weight: 400\">Regulation (EU) 2021\/383<\/span><\/a><span style=\"font-weight: 400\">.<\/span><\/p>\n<p style=\"text-align: justify\"><span style=\"font-weight: 400\">During the evaluation of PPP applications, when a Member State considers that a co-formulant could meet one or more of the criteria set out in the annex to Regulation 2023\/574, it will have to notify the other Member States, the Commission and the European Food Safety Agency (EFSA) with an assessment report. When criterion 10 applies \u201c<\/span><i><span style=\"font-weight: 400\">[&#8230;], having regard to realistic conditions of use and good plant protection practice, [the co-formulant] does not comply with one of the criteria for the approval of active substances as provided for in Annex II to Regulation (EC) No 1107\/2009, when used as a co-formulant in a plant protection product<\/span><\/i><span style=\"font-weight: 400\">\u201d, EFSA will conduct an independent assessment and update the report on the co-formulant.\u00a0<\/span><\/p>\n<p style=\"text-align: justify\"><span style=\"font-weight: 400\">The Commission will then present a draft regulation.
