{"id":6605,"date":"2023-04-28T07:22:47","date_gmt":"2023-04-28T07:22:47","guid":{"rendered":"https:\/\/lynxee.consulting\/?p=6605"},"modified":"2023-05-03T07:27:18","modified_gmt":"2023-05-03T07:27:18","slug":"europe-echa-new-hazard-classes-details-of-the-application-dates","status":"publish","type":"post","link":"https:\/\/lynxee.consulting\/en\/europe-echa-new-hazard-classes-details-of-the-application-dates\/","title":{"rendered":"EUROPE \u2013 ECHA : New hazard classes \u2013 Details of the application dates"},"content":{"rendered":"<p style=\"text-align: justify\"><span style=\"font-weight: 400\">The European Commission has published a <\/span><a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/EN\/TXT\/?uri=CELEX%3A32023R0707&amp;qid=1680506244011\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400\">Delegated Regulation (EU) 2023\/707<\/span><\/a><span style=\"font-weight: 400\">, which defines three new hazard classes and criteria for the classification, labelling and packaging of substances and mixtures.<\/span><b> This regulation enters into force on 20 April 2023 <\/b><span style=\"font-weight: 400\">(for more details, <\/span><a href=\"https:\/\/lynxee.consulting\/en\/europe-com-publication-of-the-regulation-amending-clp\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400\">see our previous article<\/span><\/a><span style=\"font-weight: 400\">).<\/span><\/p>\n<p>&nbsp;<\/p>\n<p style=\"text-align: justify\"><span style=\"font-weight: 400\">Further information on <\/span><b>transitional periods and dates when the regulation starts to apply<\/b><span style=\"font-weight: 400\"> to different substances and mixtures is available on the <\/span><a href=\"https:\/\/echa.europa.eu\/fr\/new-hazard-classes-2023\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400\">ECHA website<\/span><\/a><span style=\"font-weight: 400\">.\u00a0<\/span><\/p>\n<p style=\"text-align: justify\"><span style=\"font-weight: 400\">For <\/span><b>substances already on the market<\/b><span style=\"font-weight: 400\">:\u00a0<\/span><\/p>\n<ul style=\"text-align: justify\">\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">the Member States can make proposals for harmonised classification and labelling (CLH) with the new hazard classes and manufacturers, importers, downstream users and distributors can self-classify their substances accordingly <\/span><b>from 20 April 2023<\/b><span style=\"font-weight: 400\">;<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">the manufacturers, importers, downstream users and distributors will not yet be required to classify their substances according to the new hazard classes during <\/span><b>the transitional period from 1 May 2025 to 1 November 2026<\/b><span style=\"font-weight: 400\">. During this period, the new hazard classes can be applied on a voluntary basis;<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">all manufacturers, importers, downstream users and distributors <\/span><b>must apply the new hazard classes from 1 November 2026<\/b><span style=\"font-weight: 400\">.<\/span><\/li>\n<\/ul>\n<p style=\"text-align: justify\"><span style=\"font-weight: 400\">For<\/span><b> new substances on the market, <\/b><span style=\"font-weight: 400\">companies need to comply with the<\/span><b> new rules from 1 May 2025<\/b><span style=\"font-weight: 400\">.<\/span><\/p>\n<p style=\"text-align: justify\"><span style=\"font-weight: 400\">For<\/span><b> mixtures already on the market<\/b><span style=\"font-weight: 400\">:<\/span><\/p>\n<ul style=\"text-align: justify\">\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">the Member States can make proposals for harmonised classification and labelling (CLH) with the new hazard classes and manufacturers, importers, downstream users and distributors can self-classify their mixtures accordingly <\/span><b>from 20 April 2023<\/b><span style=\"font-weight: 400\">;<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">the manufacturers, importers, downstream users and distributors will not yet be required to classify their mixtures according to the new hazard classes during <\/span><b>the transitional period from 1 May 2026 to 1 May 2028<\/b><span style=\"font-weight: 400\">. In the meantime, companies and Member State authorities can use current guidance<\/span> <span style=\"font-weight: 400\">on <\/span><a href=\"https:\/\/efsa.onlinelibrary.wiley.com\/doi\/10.2903\/j.efsa.2018.5311\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400\">identifying endocrine disruptors<\/span><\/a><span style=\"font-weight: 400\"> and on <\/span><a href=\"https:\/\/echa.europa.eu\/documents\/10162\/17235\/information_requirements_part_c_en.pdf\/e56a6015-807e-46eb-b808-e5a7dc9fd572?t=1498474748441\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400\">PBT (persistence, bioaccumulation, toxicity) assessment<\/span><\/a><span style=\"font-weight: 400\">.\u00a0<\/span><\/p>\n<p style=\"text-align: justify\"><span style=\"font-weight: 400\">Furthermore,<\/span><b> the new hazard classes will be included into IUCLID during spring 2024<\/b><span style=\"font-weight: 400\">.
