{"id":8089,"date":"2024-12-12T08:34:17","date_gmt":"2024-12-12T08:34:17","guid":{"rendered":"https:\/\/lynxee.consulting\/?p=8089"},"modified":"2025-01-06T08:36:31","modified_gmt":"2025-01-06T08:36:31","slug":"europe-updated-clp-regulation-comes-into-force","status":"publish","type":"post","link":"https:\/\/lynxee.consulting\/en\/europe-updated-clp-regulation-comes-into-force\/","title":{"rendered":"EUROPE: Updated CLP Regulation comes into force"},"content":{"rendered":"<p style=\"text-align: justify\"><a href=\"https:\/\/eur-lex.europa.eu\/eli\/reg\/2024\/2865\/oj?eliuri=eli%3Areg%3A2024%3A2865%3Aoj&amp;locale=en\" target=\"_blank\" rel=\"noopener\"><b>Regulation (EU) 2024\/2865 of the European Parliament and of the Council<\/b><\/a> of 23 October 2024 amending Regulation (EC) No 1272\/2008 on classification, labelling and packaging of substances and mixtures (CLP Regulation) has been published on 20 November 2024.<\/p>\n<p style=\"text-align: justify\">Both the CLP Regulation text and its annexes are modified. This updated CLP Regulation aims to better identify and classify hazardous chemicals, as well as improve the communication on chemical hazards.<\/p>\n<p style=\"text-align: justify\">It <b>enters into force from 10 December 2024<\/b>, with several <b>transitory periods<\/b> (generally up to 1 July 2026 for obligations on industry or 1 January 2027 for some rules like those on label formatting). Substances and mixtures which have been placed on the market before these applicable dates do not need to be re-labelled and re-packaged based on the new rules, but they can continue to be in the supply chain until 1 July 2028 and 1 January 2029 respectively.<\/p>\n<p style=\"text-align: justify\">Among the changes are:<\/p>\n<ul>\n<li style=\"text-align: justify\">Clarification of the rules for classification of mixtures and also for substances with more than one constituent;<\/li>\n<li style=\"text-align: justify\">Role of grouping in harmonised classification (group of similar substances);<\/li>\n<li style=\"text-align: justify\">Rules for clearer labelling of hazardous chemicals (introducing digital labelling and improving the legibility of labels);<\/li>\n<li style=\"text-align: justify\">Changes to the information submitted to and published in the classification and labelling inventory;<\/li>\n<li style=\"text-align: justify\">Right for the European Commission to ask ECHA or EFSA to prepare proposals for harmonised classification and labelling;<\/li>\n<li style=\"text-align: justify\">Rules for sale of chemicals at refill stations;<\/li>\n<li style=\"text-align: justify\">Clarification of the role of distributors as potential duty holders for poison centre notifications.<\/li>\n<\/ul>\n<p style=\"text-align: justify\">New hazard classes for substances were already adopted last year (see <a href=\"https:\/\/lynxee.consulting\/en\/europe-echa-new-hazard-classes-details-of-the-application-dates\/\" target=\"_blank\" rel=\"noopener\">our previous post<\/a>). The regulation now considers these as hazards of highest concern, normally subject to harmonised classification. Companies should assess and review their portfolio of substances and mixtures and inform ECHA about any new classifications.
