30 November 2022A public consultation was launched by the French ministry of Agriculture and Food from 28 November to 18 December 2022 inclusive on a draft order on measures to protect persons when using certain plant protection products and amending the order of 4 May 2017 on the marketing and use of plant protection products and their adjuvants referred to in Article L. 253-1 of the Rural and Maritime Fishing Code.
The draft order introduces a non-reducible safety distance of 10 metres when treating aerial parts of plants with a product classified as CMR 2, for which the marketing authorisation does not include a safety distance and for which no admissible application to update the conditions of use has been registered by Anses by 1 October 2022. Among the 296 different products classified CMR2 and authorised in France, 85 applications were considered as complete.
This safety distance applies to treatments carried out near residential areas, places with vulnerable persons as defined in Article L. 253-7-1 of the Rural Code, and areas where workers are regularly present. This non-reducible distance of 10 metres is required for all uses of products on a list attached to the consultation and published in the Official Bulletin of the Ministry of Agriculture.
