
FRANCE – ANSES: Prohibited co-formulants, implementation of Regulation (EU) 2026/1120
30 June 2026Anses published an update of the note “National Provisions Regarding the Protection of Bees and Other Pollinating Insects” (version 5, 1 July 2026 (in French)).
The main changes are as follows:
- In Point 2, a clarification of the procedures for submitting complementary data for the uses concerned by the Order of 20 November 2021, depending on the type of authorisation application (i.e., case of France acting as the rapporteur or concerned Member State, and case of mutual recognition dossier) is added. The note indicates that the complementary assessment conducted by Anses may result in longer assessment periods.
- In Point 3.1, it is specified that pheromone-based products that are to be applied via foliar spray are excluded from the mention “not concerned” assigned to products containing only pheromone active substances.
- In Point 3.2, regarding new authorisations for generic and resale products, it is stated that from 1 January 2026, if the reference product has not been characterised according to the Order of 28 November 2003 (insecticides or acaricides) or the Order of 20 November 2021 (all products), then application on flowering attractive crops and in “bee foraging areas” is prohibited for the uses concerned.
- In Point 5, regarding transitional provisions, it is reminded that, as of 1 January 2026, and with the exception of cases covered by Point 6.2 (see below), products other than insecticides and acaricides may no longer be used on flowering attractive crops and on “bee foraging areas” unless the complementary data required to conduct the risk assessment for bees have been submitted to Anses prior to 1 January 2026.
- In Point 6.2, the procedures for submitting the complementary data in order to support uses during the flowering period of crops that were removed from the list of non-attractive crops by the opinion of 5 July 2024 (i.e., lentil, pea (Pisum sativum), soybean and grapevine) are updated following the Ministry of Agriculture’s decision to postpone the deadline for providing these data to 1 July 2026.
