24 April 2023Following the public consultation from 28 November to 18 December 2022, the ministry of Agriculture and Food published on 21 March 2023 in the Official Journal of the French Republic the Order of 14 February 2023 on measures to protect persons when using certain plant protection products and amending the order of 4 May 2017 on the marketing and use of plant protection products and their adjuvants referred to in Article L. 253-1 of the Rural and Maritime Fishing Code.
The order introduces a non-reducible safety distance of 10 metres when treating aerial parts of plants with products whose the marketing authorisation does not include a safety distance and whose uses are on a list published in the Official Bulletin of the Ministry of Agriculture and established on the basis of information transmitted by Anses.
This safety distance applies to treatments carried out near residential areas, places used for pleasure, places with vulnerable persons as defined in Article L. 253-7-1 and et au III de l’article L. 253-8 of the Rural Code, and areas where workers are regularly present.
The order came into force on 22 March 2023.The list of concerned uses was published on 6 April 2023.
To be noted, the Order of 14 February 2023 mentions that non-reducible safety distance of 10 metres is set for “certain plant protection products containing a substance suspected of being carcinogenic, mutagenic or toxic to reproduction“. The list initially under consultation specifying “plant protection products classified as carcinogenic, mutagenic or reprotoxic category 2”. However, in the final version of the list, no reference is made to CMR2 and in the Article 14-1-1 added to the Order of 4 May 2017, no clarification is provided on the products that can be potentially candidate to the inclusion in the list, and therefore concerned by this new safety distance of 10 metres.
