
FRANCE: Updated of the list of PPPs affected by the minimum safety distance of 20 metres
31 July 2025The French Decree No. 2025-629 on various provisions relating to the authorization of plant protection products (PPP) was published on 10 July 2025.
The aim is to specify the procedures for processing applications for PPP marketing authorisations by ANSES, in order to improve information and harmonisation of the conditions for issuing crop protection products.
The French Rural and Maritime Fishing Code is amended, in particular by the addition of two articles.
The new Article R.253-5-1 specifies that the French Ministry of Agriculture may establish by order, after consulting INRAE, a list of uses intended to control harmful organisms or undesirable plants that significantly affect agricultural and food production potential and against which there are no, insufficient or likely to disappear in the short term control methods, within the limit of 15% of the uses listed in the national catalogue of plant protection uses. This article also stipulates that ANSES must take this list into account in its schedule for examining applications for marketing authorisations and applications for modification, renewal or withdrawal of existing marketing authorisations.
The new Article R.253-14-1 concerns applications for marketing authorisation via mutual recognition (Article 40 of Regulation (EC) No 1107/2009). This article specifies that when examining such an application, ANSES shall take into account the agronomic, phytosanitary and environmental circumstances, including climatic conditions, prevailing in France, even if these were not taken into account in the assessment carried out by the reference Member State. The relevant information may be submitted to ANSES, on its own initiative or that of the applicant, within the time limit specified in Article 42 of Regulation (EC) No 1107/2009. ANSES may attach conditions or restrictions of use to the marketing authorisation issued, in addition to those of the authorisation issued by the reference Member State, to take account of the conditions prevailing on French territory; for the same purpose, ANSES may exclude certain areas of the national territory from the authorisation.
The decree came into force on 11 July 2025.
