FRANCE – ANSES: Details on Transitional Measures as regards the New Provisions for the Protection of Bees

Anses released a second version of its Note providing general and administrative details concerning the new dispositions that apply in France for the protection of bees and other pollinators from plant protection products and adjuvants, following the entry into force of the new French “bee” Order of 20 November 2021.

This new version includes details on the transitional measures (Section 6 of the Note) that are provided for in Articles 8-II to -V of the Order for products other than insecticides and acaricides:

The notification to Anses for the intended submission of additional data necessary for the implementation of the national provisions for bees, which must be carried out 18 months before submission, will be made via e-mail. Details on the content are given in Section 6.1 of the Note.
For products for which the renewal dossier is to be submitted before 1 July 2024 (Article 8-II of the Order), the additional data will have to be provided either with the renewal dossier or subsequently, as part of a modification of conditions of use dossier (PMOD) submitted no later than 1 July 2024.
It is noted that if the PMOD dossier is submitted within 3 months after having passed the completeness check for the renewal dossier, then the assessment of additional data will be integrated to the conclusion of the renewal dossier.
For products for which the renewal dossier is to be submitted after 1 July 2024 (Article 8-III of the Order), the additional data will have to be provided either with the renewal dossier or as part of a PMOD dossier submitted no later than 1 January 2026.
