FRANCE: Decree for CEPP Certificates (plant protection product savings certificates)

The decree on the implementation of CEPP Certificates was published on 28 August 2016. It was expected since the publication of the Ordinance regarding the experimental CEPP procedure, in October 2015.

This relates to Ecophyto National Action Plan.

The experimentation period runs from 1 July 2016 to 31 December 2021.

This Decree sets:

• The unit amount of the fixed penalty by CEPP Certificate: 5 Euros;

• The categories of persons eligible to experimentation:
  • Entity who made at least one full calendar year of sale on 31 December 2015,
  • Entity who will have conducted at least one full calendar year sales by 31 December 2018;

• Products included in the experimentation: plant protection products, except seed treatments, biocontrol products and products used exclusively in the context of mandatory control programmes;

• The conditions in which actions are defined to benefit from CEPP certificates and the value of those actions and certificates: average sales of plant protection products made, expressed in number of unit doses, in three reference years among the last five calendar years. Annual sales are the amounts declared for RPPD (Charge for diffuse pollution). The obligation of performing actions for each entity, fixed in number of certificates, is equal to 20% of its reference sales;

• The conditions of issue by the administrative authority of certificates and the control of corresponding actions: electronic application with supporting documentation;

• The conditions under which the experiment is evaluated: publication of an annual report.

Publications in the Official Bulletin are announced:

• calculation methodology and value of reference unit doses for each active substance;
• standardised actions contributing to savings of plant protection products;
• methodology for assessing standardised actions and establishing the number of associated certificates.
