FRANCE: Publication of 4 Orders ensuring the entry into force of saving certificates (‘CEPP’)

Four orders were issued late April – early May for saving Certificates (‘CEPP’). They confirm the effective entry into force of the CEPP system.

 

The first Order of 27 April 2017 describes the methodology and rules for calculating the  NODU indicator (Number of unit doses) and the frequency of calculation.

Five appendices specify:

  • Plant protection uses excluded from the NODU calculation;
  • Rules of calculation based on uses;
  • The average yield of crops;
  • Crop correspondence table (agricultural statistics and plant protection uses);
  • Reference NODU values ​​for each substance.

 

The second Order of 27 April 2017 defines the methodology for evaluating standardised actions. Each standardised action is evaluated according to three components in order to establish the number of associated certificates:

  • Component 1: its effect on the reduction of use and impact;
  • Component 2: its potential development;
  • Component 3: its ease of implementation and economic record.

 

The Order of 3 May 2017 defines the modalities of application for the grant of CEPPs.

Applications for the issue of CEPP referred to in Article R. 254-35 of the Rural Code and for sea fishing shall be made by means of an electronic application accessible at the following address: https: // alim.agriculture.gouv.fr/cepp/

 

The Order of 9 May 2017 defines standardised measures for the saving of plant protection products. Twenty five standardised actions are defined.

FRANCE: New Decree for PPP saving certificates (‘CEPP’)

A new decree specifying the modalities of the experimentation of PPP saving Certificates (‘CEPP’) has just been published.

This publication follows the adoption of the so-called Potier’s law concerning the fight against agricultural land grabbing and the development of biocontrol which had restored the ‘CEPP’.

In the coming days, five new standardised actions will be published which can be implemented in this framework. Moreover, amongst the 20 existing actions, some will be completed in order to widen the list of products and materials. Finally, 60 proposals for action are currently being evaluated and will be able to integrate the system shortly.

FRANCE: Re-implementation of plant protection products saving certificates (‘CEPP’)

The law No.2017-348 of 20 March 2017 concerning the fight against agricultural land grabbing and the development of biocontrol re-implements the plant protection products saving certificates (‘CEPP’). Indeed in December 2016, the Ordinance No.2015-1244 of 7 October 2015 regarding the experimental CEPP procedure was called off by the Council of State for procedural reasons further to an appeal of pesticides producers and distributors.

An assessment of the experimental procedure aiming at setting up actions contributing to savings of plant protection products will be performed and published before 1st January 2020.

A draft decree repeats the provisions of Decree No. 2016-1166 of 26 August 2016 concerning the implementation of CEPP and is subject to public consultation from 8 March to 29 March 2017. The draft decree sets the conditions and modalities for the calculation and the implementation by distributors of actions contributing to the reduction of the pesticides use, risks and impacts. The unit amount of the fixed penalty by missing CEPP Certificate on 31 December 2021 compared to the notified obligation  is 5 euros.

FRANCE: Three Orders for CEPP certificates (plant protection product savings certificates)

Three Orders for CEPP certificates (plant protection product saving certificates) were published on 22 September 2016. They were expected further to the Decree on the implementation of CEPP certificates released on 28 August 2016.

These orders define:
– standardised actions contributing to savings of plant protection products

These standardised eligible actions include areas such as biocontrol, decision-making tools, agricultural equipment, precision crop management and environmental certification.

– assessment methodology of standardised actions of plant protection products savings

Each action is evaluated from three components to determine the number of associated certificates: its effect on the reduction of use and impact, deployment potential, ease of implementation and its economic record.

– calculation methodology and value of reference units doses of active substances

FRANCE: Decree for CEPP Certificates (plant protection product savings certificates)

The decree on the implementation of CEPP Certificates was published on 28 August 2016. It was expected since the publication of the Ordinance regarding the experimental CEPP procedure, in October 2015.

This relates to Ecophyto National Action Plan.

The experimentation period runs from 1 July 2016 to 31 December 2021.

 

This Decree sets:

  • The unit amount of the fixed penalty by CEPP Certificate: 5 Euros;
  • The categories of persons eligible to experimentation:
    • Entity who made at least one full calendar year of sale on 31 December 2015,
    • Entity who will have conducted at least one full calendar year sales by 31 December 2018;
  • Products included in the experimentation: plant protection products, except seed treatments, biocontrol products and products used exclusively in the context of mandatory control programmes;
  • The conditions in which actions are defined to benefit from CEPP certificates and the value of those actions and certificates: average sales of plant protection products made, expressed in number of unit doses, in three reference years among the last five calendar years. Annual sales are the amounts declared for RPPD (Charge for diffuse pollution). The obligation of performing actions for each entity, fixed in number of certificates, is equal to 20% of its reference sales;
  • The conditions of issue by the administrative authority of certificates and the control of corresponding actions: electronic application with supporting documentation;
  • The conditions under which the experiment is evaluated: publication of an annual report.

 

Publications in the Official Bulletin are announced:

  • calculation methodology and value of reference unit doses for each active substance;
  • standardised actions contributing to savings of plant protection products;
  • methodology for assessing standardised actions and establishing the number of associated certificates.
